EC doubts the procedure errors which blocked all of Romania's major corruption files
Publish date: 30-01-2008The European Commission voiced doubt over the so-called procedure errors invoked by courts when returning the high level corruption cases to prosecutors, this being the central idea of a preliminary report on the Romanian justice system.
The report drafted by EC contains a wide analysis of Romania's most important corruption cases. These were first suspended and then sent back to prosecutors for the resuming of the criminal investigation.
The final report is due to be released in June-July this year. EU officials close to the situation said the report has a harsher tone when it comes to Romanian than Bulgaria. Both countries joined EU on January 1, 2007.
The European Commission might even ask for the safeguard clause on justice to be activated in Romania's case, the mentioned sources noted. This would mean that the decisions made by the Romanian courts will not be taken into consideration by the EU members.
Romania's largest justice problem remains the anti-corruption fight, as all the important cases were sent back to prosecutors, with the requirement for new evidence.
In the last report on justice, release in June 2007, EC was not satisfied with the fight against corruption. The authorities in Brussels hailed the National Anticorruption Department and criticized the fact that its activity was not backed by that of the courts.
